By accessing our website, requesting a demo, or using our platform, you agree to be bound by these Terms.
If you do not agree, you may not use our services.
1. Eligibility
You represent that:
- You are at least 18 years old.
- You have authority to bind the organization you represent.
- You will use the services in compliance with all applicable laws.
Journey’s services are intended for businesses, including senior living communities and home care agencies.
2. Services Provided
Journey provides a cloud-based CRM platform designed for:
- Lead and referral management
- Sales workflow management
- Reporting and dashboards
- Marketing and engagement tools
We reserve the right to modify or discontinue features at any time.
3. Account Registration
To access certain services, you may be required to:
- Provide accurate information
- Maintain current contact details
- Protect account credentials
You are responsible for all activity under your account.
4. Fees & Payment
If you purchase a subscription:
- Fees are billed monthly or annually as agreed
- Implementation fees may apply
- All payments are non-refundable unless otherwise stated
Failure to pay may result in suspension or termination.
5. Acceptable Use
You agree not to:
- Use the platform for unlawful purposes
- Transmit harmful code
- Attempt to reverse engineer the platform
- Access data not belonging to your organization
- Violate privacy laws or messaging regulations
Journey reserves the right to suspend accounts for violations.
6. Communications & SMS Messaging
By providing your phone number and opting in via our website or platform, you consent to receive SMS communications from Journey relating to:
- Demo requests
- Account notifications
- Service-related communications
- Operational updates
Message frequency may vary.
Standard message and data rates may apply depending on your mobile carrier.
You may opt out of SMS communications at any time by replying STOP to any message. You may request assistance by replying HELP or contacting support@journeyleasing.com.
SMS consent is not required to purchase or use Journey’s services.
Journey does not sell or share SMS opt-in information with third parties for marketing purposes.
You agree to provide accurate contact information and to notify us if your phone number changes.
Journey is not responsible for delays in SMS delivery caused by carrier or network issues.
7. Data Ownership
All data entered into the Journey platform by customers (“Customer Data”) remains the property of the customer.
Journey does not claim ownership of Customer Data.
You grant Journey a limited license to process Customer Data solely for:
- Providing services
- Improving functionality
- Maintaining platform security
8. Data Security
Journey implements reasonable administrative, technical, and physical safeguards to protect data.
However, no system is completely secure, and you acknowledge inherent internet risks.
9. Confidentiality
Each party agrees to protect confidential information shared during the relationship.
Confidential information does not include information that:
- Is publicly available
- Was independently developed
- Is required to be disclosed by law
10. Intellectual Property
All platform content, code, branding, and materials are owned by Journey.
You may not:
- Copy
- Modify
- Distribute
- Reverse engineer
without written consent.
11. Service Availability
Journey strives for high availability but does not guarantee uninterrupted service.
Maintenance, updates, or external factors may result in downtime.
12. Third-Party Services
Journey may integrate with third-party providers (e.g., messaging providers, email services).
We are not responsible for:
- Third-party outages
- Third-party data practices
- External platform changes
13. Termination
Either party may terminate service:
- According to subscription agreement terms
- With written notice as outlined in agreement
Upon termination:
- Access to platform may be revoked
- Data export options may be available for a limited time
14. Disclaimers
Journey provides services “as is” and “as available.”
We do not guarantee:
- Revenue increases
- Occupancy improvements
- Referral volume growth
- Business outcomes
15. Limitation of Liability
To the fullest extent permitted by law:
Journey’s total liability shall not exceed the total fees paid in the previous 12 months.
Journey is not liable for:
- Indirect damages
- Lost profits
- Data loss
- Business interruption
16. Indemnification
You agree to indemnify and hold Journey harmless from claims arising from:
- Your misuse of the platform
- Violation of laws
- Infringement of third-party rights
17. Governing Law
These Terms are governed by the laws of the State of [Insert State], without regard to conflict of law principles.
Any disputes shall be resolved in courts located in Denton County, TX.
18. Modifications to Terms
Journey may update these Terms at any time.
